Mr. Shimon Peres, Israeli Foreign Minister, addressed the Jewish Community on the Wits
campus during his September 2002 visit to South Africa. A lady had a summons for damages served on him and the Respondent gave coverage to this event. The lady was afforded an opportunity to motivate her summons. She said that the claim for damages against Israel was based on Israel’s cruel conduct towards Palestinians.
The BCCSA held that the event was so obviously sensational and politically motivated that viewers would not have understood the item to have necessarily conveyed the only view on the matter. The Mid East conflict was a daily news event and viewers would realize that the Israel Embassy as well as Mr. Peres would deny responsibility.
