This is an appeal against the finding and sanction imposed in Adjudication No: 54/A/2021 in terms of Rule 2.5 of the Procedures. The applicant was found to have contravened Clauses 28(2)(2) and 28(3) of the Code of Conduct for Subscription Broadcasting Service Licences. The Tribunal found that the guests’ comments regarding anti-vaccination and the efficacy of vaccination against Covid-19 were not clearly based upon facts truly stated or fairly indicated and referred to. Persons who were criticised during the interview were not provided with an opportunity to respond to the criticisms. Persons with opposing views were not invited to participate in the debate. Clauses 28 (2)(2) and 28 (3) are equally applicable to all programmes irrespective of the nature thereof or the topic of debate. The appeal is dismissed and a sanction imposed.
