Appeal against First Tribunal’s finding that Respondent had not contravened any of the subclauses of Clause 28.2 of the Code of Conduct for Subscription Broadcasting Licencees. Leave to appeal allowed on two grounds, namely that a programme which dealt in essence with the same matter but had been broadcast earlier should be taken into consideration to determine the present matter and secondly whether Appellant was offered a right of reply in terms of Clause 28.3.2. The Appeal Tribunal did not uphold the first ground of appeal. The second ground of appeal was upheld and it was found that the Appellant should have been offered an opportunity to respond. Broadcaster consequently infringed Clause 28.3.2 of the Code of Conduct for Subscription Broadcasters.
