The issue before the Tribunal was whether the publication of the face of a woman who had been televisionraped, was permissible. Her face, and therefore her identity, was only divulged in one instance, while in other instances her face had been blocked out. At the hearing of the matter a letter, signed by the woman, who is over the age of 21, was handed to us. She had, in fact, provided permission for publication in the letter signed by her. Judging from the response of the broadcaster, as quoted below, this fact was not known to the Complaints Division of the Respondent. The information obviously only surfaced at a later stage.

Since the authenticity of the letter was not in doubt, the complaint was not upheld.
