The President of the United Christian Democratic Party (“UCDP”), a minority party in
Parliament, filed a complaint against SABC for not including him in their news broadcasts at 19:30 (isiZulu) and 20:30 (Sesotho) on the 15th February this year when a news conference was held with Party leaders. The Tribunal held as follows:
(1) It has been emphasised by the Constitutional Court that the protection of the rights of minorities is an integral part of our democracy. The fact that such a minority is constituted by a small group is irrelevant. It is entitled to reasonable protection in terms of the Constitution.
(2) The news clause requires that news must be broadcast fairly. It cannot be fair for SABC to, almost consistently, not broadcast what a party leader has to say.
(3) The matter is postponed until 4 July 2013. This would grant the SABC the opportunity to address the matter. If we do not hear from Mr Mfundisi before 4 July 2013, we will remove the matter from our Roll and regard the matter as having been settled amicably. The SABC is requested to provide us with a report before or on 4 July 2013 as to how the omission has been addressed. If the matter is not settled an order will have to be made against the SABC. However, we have reason to believe that the matter will be settled amicably.
