CASE NO: 01/2010 – BELTER VS e.tv – APPLICATION FOR LEAVE TO APPEAL

This is an application for leave to appeal against a judgment of the Tribunal of the Commission. The Tribunal held that the broadcast of WWE wrestling, in casu after eight in the evening, was not in contravention of the Broadcasting Code. The question is whether it is likely that the Appeal Tribunal would come to a decision that the Tribunal was clearly wrong. The Chairperson came to the conclusion that this would not be the case and dismissed the application.
