Several complaints that “pornographic” film, Emanuelle 2 had been screened at 01:05. One complaint not entertained, the complainant having been found to have made derogatory statements in regard to personnel of e-tv, thereby turning it into a vexatious complaint, which may not be entertained according to the Rules of the BCCSA.
Held that since the film fell in the category of a so-called B-movie, with some semi- explicit sex scenes and nudity, e-tv had not contravened the Broadcasting Code by screening the film at 01:00 with an age classification of 18 plus a caution as to Language, Sex, Nudity and Sex (LNVS) – for 4 minutes when the film commenced, for 6 minutes after the first advertisement break and for 3 minutes after each of the other ad breaks.
Held further that e-tv had abided by the previous judgment of the BCCSA by not broadcasting any scenes of a mixture between sex and violence, if they ever formed part of the present film. Such scenes did form part of Emanuelle 1, and led to the decision of the BCCSA that the Broadcasting Code had been transgressed. The timing of the present broadcast also differed substantially from the previous broadcast at 22:00. Complaints dismissed.
