A complaint was lodged regarding a broadcast by the Respondent during which an interview was held with a previous employee of the Complainant regarding an inquest about an incident at the Complainant’s mine, six years previously. The interviewer based the questions on a press statement without indicating that it was a press statement. The Complainant was not given an opportunity to respond to the comments/allegations made by the interviewee. It was held that the topic was a controversial issue of public importance and that the Complainant should have been given an opportunity to respond. Contravention of Clause 28(3)(2).
