This is an appeal against the adjudication by a Commissioner of the BCCSA in which it was found that a breakfast show programme of East Coast Radio contravened the Code for Free-to-Air Broadcasting Licensees. The Commissioner found that a large number of children was part of the audience when adult material was broadcast, but there was no proof of this fact. The Tribunal found that due to the nature of the Radio station and judging the context of the programme, children are not the target audience. It is ultimately the responsibility of parents/care givers to protect children from harmful material. The watershed provision of the Code is only applicable in the case of television broadcasts, not radio broadcasts. It was also decided that the privacy of the presenters was not at issue. Appeal allowed.
