As part of a news programme the SAFM broadcast relevant parts of a song which, on its own has radiobeen found to amount to the advocacy of hatred based on race. The SABC, in the present matter, however, included relevant aspects of the song in a news programme. It did not go further than what is required for listeners to remain informed in accordance with their fundamental right to be informed within the context of a news programme.  The complaint of hate speech was not upheld.
