Complainant alleged that several TV and radio news bulletins had contained errors and were not
balanced insofar as they dealt with complaints by truck drivers that the Complainant had repossessed their transport vehicles without authority to do so. The bulletins also cast suspicion on the actions of the Complainant in regard to the trucks, which were, according to a later judgment of the High Court, not in conflict with the rights of the Complainant.
Tribunal holding that although some mistakes had been made, they were not attributable to the negligence of the SABC. The Tribunal pointed out that its task in establishing whether the SABC had been negligent or not had been significantly complicated by the absence of the complainant at the hearing, to which he had been invited. He had, however, not turned up at the hearing and not indicated to the Registrar that he would not attend or what the reasons for his absence were. There was also no application for a postponement. Complaints dismissed.
