Chairperson having to decide in limine whether the Complainant should in terms of the 
Procedural Rules be required to waive its rights to action in the civil courts in this matter. Chairperson holding that given the likely intricacies of the matter, especially insofar as the leading of expert evidence is concerned, and the similarity of most issues before the Tribunal to what would take place at a trial, that it would be in the interest of fairness that the Complainant must be required to waive its rights to further legal recourse.
