5FM - Appeal against Adjudicator's Sanction for Contravening Clause 16.2 of the Code

Summary Appeal – Contended that the sentence is disturbingly disproportionate to the infringement – Held that having regard to the fact that the presenter invited and incited the public to proffer  information relating to the manufacture of explosive devices during the time when children formed part of the audience, that the presenter’s conduct was grossly irregular and negligent – Held that the  adjudicator exercised his discretion judicially in the imposition of the sentence having regard to the seriousness of the contravention.  The Appeal is dismissed.
